<Definition>

First article

The provisions stipulated by this Agreement shall apply to all facilities operated by MGA Muscle Gym Araha Beach.

<Purpose>

Article 2

The purpose of this facility is for members to maintain and improve their health.

<Membership system>

Article 3

1. This facility operates on a membership system.

2. Those who wish to become a member of this facility must provide accurate information on the application form for membership.

3. The facility may change or delete the type of membership system.

<Enrollment qualification>

Article 4

The membership qualifications for this facility are as follows.

1. Persons who strictly observe these terms and various rules of this facility (underage must have parental/guardian consent).

2. Those who are not affiliated with organized crime/gang groups.

3.Those who have declared that they are not prohibited from exercising by a doctor and/or there is no hindrance to the use of this facility at their own risk.

4.Those who are not pregnant.

5. Those who do not have infectious diseases or other diseases that may be transmitted or infected to others.

6.Those who have never received a disposition/suspension of membership from any type of membership system clubs, facility or organization, regardless of whether it is public or private.

7.Authorized appropriate personnel by MGA Muscle Gym Alaha Beach

 <Observance of regulations>

Article 5

1.Members must comply with these terms and various rules established by MGA Muscle Gym Alaha Beach

2. When using the facility, you must follow the instructions of this facility.

<Prohibition of action>

Article 6

This facility can prohibit entry or order the exit of those who fall under each of the following:

1. Member of organized crime syndicate, member of gang group.

2 Those who do not comply with these terms and various rules established by MGA Muscle Gym Alaha Beach

3 Those who are prohibited from exercising by a doctor.

4 Pregnant women

5 Those who have an infectious disease or other diseases that may be transmitted or infect others

6 Those who are under the influence of alcohol

7 If we determine that the person is acting inappropriately

8 When we determine that it is difficult for the person to use this facility due to various factors

< Disqualification, suspension, or withdrawal of membership>

Article 7

1. If a member wishes to withdraw from membership, the member must complete the written procedure at the facility reception by the 5th day of the month preceding the month in which the member wishes to withdraw.

2 After completing the procedure in the article 7-1, the membership will be withdrawn on the withdrawal date stated in the withdraw request form.

3 If membership fees/other related expenses have not been paid, they must be paid in full by the time the withdrawal notice is submitted in article 7-1.

4 If a member fails to pay the membership fee for three consecutive months or more due to any personal reasons, the member will be withdrawn from membership service. However, you will have to pay the full amount due.

 <Recess of membership>

 Article 8

1.If a member wishes to suspend membership service, the member must complete the written procedure at the facility reception by the 5th day of the month preceding the month in which the member wishes to recess.

2. During the period of suspension, the member must pay the recess fee that established by MGA Muscle Gym Alaha Beach.

3. The maximum suspension period is 6 months, and after one suspension period, the membership will be automatically reinstated, and the regular monthly membership fee will be charged.

<Membership information change>

Article 9

1. If there is any change occurred in the contents entered in the membership application form, the member must update information immediately.

2. When we send written notices, we will send to the latest address as provided by the member. We do not take responsibility for non-delivery of notices.

<Suspension of membership and expulsion>

Article 10

1.If the member falls under any of the following, the facility may suspend or expel the member's membership for a certain period and cancel the facility usage contract.

(1)  When you damage our facility reputation and credibility.

(2)  When violating this agreement or other prescribed regulations.

(3)  When the member is in arrears on debts and does not respond to the notice from this facility.

(4)  When it is found that the member has made a false declaration to the facility or concealed the fact.

(5)  When the facility judge that the operation of this facility is disturbed or that there is a risk of disturbing it.

(6)  When the facility recognizes that the member has acted to cause trouble for other members.

(7)  When we judge that the member’s behavior is inappropriate for our facility.

(8)  When it is found that the member has been involved in anti-social activity such as organized crime groups after joining the membership

2. A member whose membership has been suspended or expelled pursuant from article 10-1, shall not be able to join or enter any facility operated by MGA Muscle Gym Alaha Beach.

 <Loss of membership>

Article 11

Members shall lose their membership qualifications in the following cases.

(1) When a member withdraws

(2) When a member dies, or the corporation is dissolved

(3) When a member is expelled

(4) When the facility is closed due to inability to operate

<Transfer of membership>

Article 12

Membership of this facility is valid only for the person who registered it, and it is prohibited to transfer, inherit, or otherwise comprehensively succeed.

<Enrollment fee, administrative procedure fee, membership fee>

Article 13

1. Admission fees, administrative fees, and membership fees are valid until the time of withdrawal, and admission fees and administrative fees will not be refunded for any reason.

2. Membership fees already paid will not be refunded for any reason after the start date of use stated in the membership application form.

3.Members must pay membership fees until the month of withdrawal, regardless of whether or not they use the facilities.

4. We may request the member to pay the amount specified in the type of use of this facility, and the member will be obligated to pay.

<Revision of admission fee, membership card issuance administrative fee, membership fee, usage fee, etc.>

Article 14

1. The facility may revise the admission fee, membership card issuance administrative fee, membership fee, usage fee, etc. In this case, the admission fee will be applied only to the new members.

2. When revising Article 14-1, members shall be notified at least one month in advance.

3. We shall not be obligated to notify members in advance of the schedule, period and content of campaigns or sales.

 <Business days and business hours>

Article 15

The business days and business hours of this facility shall be specified in separately.

<Facility usage restrictions>

Article 16

1. The facility may restrict the use of all or part of the facility for various events such as competitions, schools, etc., management of the facility, or other cases deemed necessary by the facility.

2. If a member wishes to use such facilities, a reservation is required, and this facility shall have all the authority to decide whether or not to use the facilities.

<Use of facilities for non-members>

Article 17

We may allow non-members to use this facility only when authorized.

<Closing>

Article 18

1. Entire/part of facility may close due to following circumstances:

(1) When it is not appropriate for the facility to operate due to weather, disasters, or other unavoidable reasons.

(2) When it is not appropriate for the facility to operate due to warnings.

(3) When inspecting, repairing or refurbishing facilities.

(4) When the facility needs to be closed for a certain period of time during the year-end and New Year holidays, or for other circumstances.

2. If the facility is to be closed for reasons (3) and (4) above, the member shall be notified at least one month in advance.

3. If the facility is to be closed for reasons (1) and (2) above, the facility does not need to notify members in advance and, in principle, do not need to refund membership fees to members.

<Accident>

Article 19

We will not be held responsible for any personal or physical accidents that occur to the member or a third party at this facility unless there is intentional or gross negligence on our part.

 <Theft and loss>

Article 20

We will not be held responsible for any loss or theft that occurs when a member uses this facility unless there is intentional or gross negligence on our part.

<Handling of lost & found Item / waiver of rights>

Article 21

If you do not claim your items during our lost & found storage period, you will be deemed to have abandoned your ownership rights and will not raise any objection to our disposal process.

However, if there is a risk of causing health and safety problems such as corruption, disposal can be done even before the above period.

<Member's liability for damages>

Article 22

If a member causes damage to the facility or a third party due to reasons attributable to the member within the facility, the member shall be responsible for compensation.

<Handling of application form>

Article 23

Documents related to personal information will be stored appropriate location in manner after they have been entered into this system.

<Dissolution>

Article 24

1.This facility may be dissolved due to unavoidable reasons. In that case, all members shall be notified three months in advance.

2. If the reason for dissolution is natural disaster, order of public authority, coercion or other force majeure, the notice period in the preceding paragraph can be shortened.

3. In the event of dissolution of the facility, we will not provide any special compensation to the members.

 <Notification method>

Article 25

Notices or advance notices regarding these terms and various rules, regulations and agreement of the facility shall be made by posting them in a designated place of the facility, except for important matters, and all members shall be deemed to have received such advance notice.

<Amendments to these terms and other rules>

Article 26

we may revise these terms, bylaws, terms of use, and other matters related to the operation and management of the facility and will apply to all members.

<Effective date>

Article 27

This Agreement will commence effective April 1, 2023.
